EXTERMINA has established this Privacy Policy in order to transparently inform users of the website hosted at the following address: www.extermina.be (hereinafter the “Website”) about the manner in which personal data is collected and processed by EXTERMINA.
The term “User” refers to any user, meaning any natural or legal person who visits or interacts in any way with the Website.
In this respect, EXTERMINA determines all the technical, legal, and organizational means and purposes of the processing of Users’ personal data. EXTERMINA undertakes to take all necessary measures to ensure that the processing of personal data complies with the Belgian Law of July 30, 2018 relating to the protection of natural persons with regard to the processing of personal data (hereinafter the “Law”) and with the European Regulation of April 26, 2016 on the protection of personal data and the free movement of such data (GDPR) (hereinafter the “Regulation”).
EXTERMINA is free to choose any natural or legal person who processes users’ personal data on its request and on its behalf (hereinafter the “Processor”). Where applicable, EXTERMINA undertakes to select a Processor providing sufficient guarantees regarding the technical and organizational security measures for the processing of personal data in accordance with the Law and the Regulation.

The use of the Website by Users may result in the communication of personal data. The processing of such data by EXTERMINA, in its capacity as Data Controller, or by service providers acting on behalf and for the account of EXTERMINA, will comply with the Law and the Regulation.

When visiting and using the Website, the User agrees that EXTERMINA collects and processes, according to the methods and principles described in this Privacy Policy, the following personal data: First name, Last name, Company, Address, Phone number, Email address.

By accessing and using the Website, the User declares that they have read and freely, specifically, informedly and unambiguously agreed to the processing of their personal data. This consent relates to the content of this Privacy Policy.
Consent is given through a positive action whereby the User ticks the box referring to the Privacy Policy via a hyperlink. This consent is an essential condition for carrying out certain operations on the Website or for enabling the User to enter into a contractual relationship with EXTERMINA.
Any contract between EXTERMINA and a User concerning the services and goods offered on the Website is subject to the User’s acceptance of the Privacy Policy.

In accordance with Article 13 §2 of the Regulation and the Law, the Data Controller retains personal data only for the time reasonably necessary to fulfill the purposes for which it is processed.
In any case, this period will be less than 5 years.
7. Recipients of Data and Disclosure to Third Parties
Personal data may be transmitted to employees, collaborators, subcontractors, or suppliers of EXTERMINA who provide adequate data security guarantees and who collaborate with EXTERMINA in the marketing of products or the provision of services. They act under the direct authority of EXTERMINA and are notably responsible for collecting, processing, or subcontracting this data.
In all cases, the recipients of the data and those to whom the data has been disclosed comply with the content of this Privacy Policy. EXTERMINA ensures that they process this data only for the intended purposes and in a confidential and secure manner.
If data is disclosed to third parties for direct marketing or prospecting purposes, the User will be informed beforehand so that they may give their consent to the use of their personal data.
8. Users’ Rights

a. Right of Access
In accordance with Article 15 of the Regulation, EXTERMINA guarantees the User the right to access their personal data.
The User has the right to obtain access to their personal data and the following information:
- the purposes of processing
- the categories of personal data concerned
- the recipients or categories of recipients to whom the personal data have been or will be disclosed
- the retention period of the data, where possible
- the existence of automated decision-making, including profiling
The Data Controller may charge a reasonable fee based on administrative costs for additional copies requested by the User.
The data will be provided within one month of receiving the request.
b. Right to Rectification
EXTERMINA guarantees the User the right to rectify and erase personal data.
In accordance with Article 16 of the Regulation, incorrect, inaccurate, or irrelevant data may be corrected or deleted at any time.
c. Right to Erasure (Right to be Forgotten)
The User has the right to obtain the deletion of their personal data as soon as possible in the cases listed in Article 17 of the Regulation.
This right does not apply where processing is necessary for:
- exercising the right of freedom of expression and information
- compliance with a legal obligation
- the establishment, exercise, or defense of legal claims
d. Right to Restriction of Processing
The User has the right to obtain the restriction of the processing of their personal data in the cases listed in the Regulation.
e. Right to Data Portability
In accordance with Article 20 of the Regulation, Users have the right to receive their personal data from EXTERMINA in a structured, commonly used, and machine-readable format and have the right to transmit that data to another data controller.
f. Right to Object and Automated Individual Decision-Making
The User has the right at any time to object to the processing of their personal data, including automated processing carried out by EXTERMINA.
When personal data is processed for direct marketing purposes, the User has the right to object at any time.
g. Right to Lodge a Complaint
The User has the right to lodge a complaint regarding the processing of their personal data with the Data Protection Authority in Belgium.
